Terms of Service

1. Accepting these terms

escape.fm is run by ILLUSION Tech Limited, a company registered in Hong Kong ("we"). By using the player or the plugin, or by signing in, you agree to these terms and to the Privacy Policy. If you do not agree, please do not use escape.fm.

2. The service

• Player: the web player, the iPhone app (with its Apple Watch app and widgets), the Mac app, the Apple TV app and the Apple Vision Pro app. It plays AI-made instrumental music online, with three keys: play/stop, next, and a heart that keeps the moment you are hearing.
• Plugin: runs on your computer and tells the player two tags, your work mode and your AI agent's state, so the music follows them.

3. Accounts

• You can use the player and the plugin without signing in. Bringing task states together across your devices, and keeping them on the same music, needs an account.
• Signing up needs an email address you can receive mail at. Accounts have no password; you sign in with a code sent by email, with Sign in with Apple, or with Google or GitHub.
• You are responsible for what happens under your account. If someone else is using it, contact us as soon as possible.
• You must be at least 16 to sign up.

4. Free listening, and Plus

Listening is free, with or without an account: play, stop and next, and music that follows the time of day.

Plus is everything that knows you: your AI agents, walking and running, Focus and sleep, the evening at home, the weather, the heart, the papers, posters and the year, and listening offline. Plus may include a free trial, as the app shows when you sign up. Plus is a subscription bought in the app through Apple, monthly or yearly, at the price the App Store shows. It renews automatically until you cancel it in your App Store account settings, at least 24 hours before the period ends. Apple takes the payment and handles renewals, refunds and Family Sharing, under its own terms. Plus belongs to your escape.fm account, so it is there on every device you sign in to, and on the web.

We will never charge you without your knowing. If what is free or what Plus includes changes, we say so on the website first.

5. The music and your licence

All the music escape.fm plays is made by AI models, with no vocals or lyrics.

We allow you to listen to it online through the player, for personal use, including while you work. This licence is non-transferable and non-exclusive. Without our written permission, you may not:

• download, save, record or redistribute the music;
• scrape the audio files or the track list in bulk;
• use the music to train, fine-tune or evaluate any model;
• play it publicly in business premises, or use it for advertising or other commercial purposes;
• use it as background music in live streams or published videos. We may allow this once we have checked the relevant licence, and will update these terms if so.

6. Acceptable use

You may not:

• interfere with or attack the service, or get around rate limits or other protections;
• fake plugin reports;
• try to obtain other people's plugin keys or accounts;
• use the service for anything unlawful.

7. Changes and interruptions

We may add, change or remove features, and the service may be interrupted for maintenance or by faults. The plugin judges the work mode by keywords and is sometimes wrong. We do our best to keep the service stable, but do not promise it will be uninterrupted or free of errors.

8. Ending

• You can stop using escape.fm at any time, and delete your account in the account panel.
• If you break these terms, we may suspend or end your use of the service. For minor breaches we will warn you first.

9. Disclaimer

The service is provided "as is". To the extent the law allows, we make no warranties about it, express or implied, including of merchantability, fitness for a particular purpose and non-infringement.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or incidental losses, or loss of profits, arising from using or being unable to use the service. Our total liability to you is limited to what you paid us in the 12 months before the event, or USD 100, whichever is more. Liability that the law does not allow to be excluded or limited is not affected by this section.

11. Governing law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China. Disputes arising from these terms or the service are subject to the jurisdiction of the courts of Hong Kong. Protections that the law where you live gives consumers, and that cannot be waived, are not affected by this section.

12. Changes to these terms

When these terms change we update this page and the effective date at the top. Significant changes are announced prominently on the website before they take effect. Continuing to use the service after a change takes effect means you accept the new terms.
